Post #2: Should the Senate Vote to Confirm Kavanaugh?

Due October 5th

President Trump has nominated Justice Brett Kavanaugh to the seat the Justice Kennedy is leaving on the US Supreme Court.  The US Senate will get to vote on his confirmation and the Senate's Judiciary Committee (which Senator Amy Klobuchar is on) has been conducting hearings on Kavanaugh to determine whether they will support his nomination.

Until last week it looked like the US Senate was going to approve Kavanaugh because Trump had enough votes.  However, there were already groups organizing against Kavanaugh and trying to persuade moderate Republicans and Democrats to vote against him.

However, recently a former high school classmate of Kavanaugh's has accused him of attempted sexual assault and now the Judiciary Committee is extending their hearings and delaying the vote.

I have given you two articles with background on Kavanaugh.  Continue to do your own research on him and answer the following prompt:

If you were Minnesota's senator on the Judiciary Committee how would you vote?  Why?


Your answer should include at least 3 pieces of evidence.  One of them can be from the pieces I pass out in class.

**Please be thoughtful about what you post and how you phrase your argument.  It is important to remember that the issue of sexual assault can be very emotional.

In my opinion, I do not believe Brett Kavanaugh should be considered for a Supreme Court Justice. First of all, he has multiple sex allegations against him (1). Now, these accusations have not yet been proven, and I do realize they are almost impossible to prove. However, a man with such charges against him should not be advanced to the highest court of the land (2). Until he is proven innocent, or guilty, there should be no disciplinary or rewarding action taken toward him. If he is proved innocent, I do believe the false accuser should be punished, though. If a man has those charges against him, I believe there are better men and women more suited for the position of Supreme Court Justice. Also, Kavanaugh had a moment where he lashed back against Senator Klobuchar during a hearing (3). I do realize that he was under a stressful situation in which he was defending himself but I believe a Supreme Court Justice should be used to stress and be able to operate normally under such conditions. I hope by writing this I was reasonable to both sides of the debate without offending anyone.

If I were a Minnesota Senator, I will not have my voting be considered for Kavanaugh until they have found him innocent or guilty. In the first article "Senators signal Kavanaugh appears on solid ground to win confirmation", there has not been any clear proof against Kavanaugh from all of the sex allegations towards him. Some Democrats are in support of Kavanaugh because of no clear proof and he has defended himself well through this. One Democrat Manchin who has made a statements says, "Both sides have been deplorable in how they've handled themselves,... That's what makes people sick"(1). I would not be happy that the Democratic party is still in consideration and support of Kavanaugh even though he has these sex allegations pinned on him. Secondly in the article "Confirmed: Brett Kavanaugh Can't Be Trusted", there were past theft allegations of Kavanaugh and the Republican party that tried covering up for him. These allegations made against Kavanaugh was that he stole documents off of a Democratic Senator's computers. These allegations are serious and I wouldn't want to put my vote on him to be in the highest court of the land. There are consistent lies. It is stated in the article that "He misstates facts under oath, and the Republicans cover for him by making it hard, it not impossible, to get the documents proving it"(2). This just shows how untruthful this man has been. Lastly in the article "Hillary Clinton on Brett Kavanaugh: "There's a lot to be concerned about"", Hillary Clinton doesn't believe in someone like Kavanaugh with such allegations should even be a Supreme Court nominee. Clinton said, "For anyone who believes there's such a thing as judicial temperament and that we want judges, particularly those on our highest court to approach issues, approach plaintiffs and defendants with a sense of fairness, that there's a lot to be concerned about,"(3). She stated that she believes the women who made the sex allegation against Kavanaugh and that his behavior towards it has not been the best to show he should be confirmed. If I have given this statement and Kavanaugh responded back with backlash, I would not confirm his vote at all. Overall, based on Kavanaugh's character in all of these articles, I would not confirm him. There are many allegations that he has not been clear on once made against him. I agree that he shouldn't have been nominated in the first place.

If I were a Minnesota senator on the judiciary committee I would not vote to confirm Brett Kavanaugh. He has a history of lying publicly about his views and involvement. He has stated publicly that Roe V. Wade is a set deal, but in a leaked email he has expressed his thoughts on overturning Roe V. Wade. He has lied about his knowledge of George W. Bush's wiretapping program but leaked emails have confirmed once again that he was aware of what Mr. Bush was doing (1). Brett Kavanaugh is a man this country can't and should not trust. Secondly, Dr.Christine Blasey Ford has testified about Brett Kavanaugh sexually assaulting her at a party in the summer of 1982, something which should be thoroughly looked at, especially considering president Trump has made a mockery of her accusations and is telling his supporters to "think of there sons" (2), when he has also been accused of sexual misconduct and has been recording casually talking about sexually assaulting women. Something to which we as a country has ignored. Lastly, Kavanaugh has shown inappropriate behavior in his testimony in which he made accusations of a conspiracy of the democratic party and showed deep partisanship, something that no supreme court justice who considers themselves to be representing the constitution should show (3). I think that Kavanaugh shouldn't even be considered for this job based anymore, and there are more qualified men and women who will do a much better job at upholding our constitution than he can.

The senate should not vote Brett Kavanaugh into the Supreme Court. With the recent allegations of sexual assault aside, Kavanaugh has a standing history of lying about his views and also lying under oath in court. (1) Back in 2003 an email of his was leaked stating the Roe v. Wade could be overturned and that it was not settled because the Supreme Court can overrule itself at any time, but later he went on to say that Roe v. Wade was a done deal and was the law of the land. With the resent allegations considered he still should not be voted in. A person who has not one, but three separate people accusing him of sexual assault/misconduct should not be voted into the highest court in the land. One of these persons has history of telling her therapist and her husband years before this nomination was even considered or thought of. (2) During the Judicial Review Senator Amy Klobuchar was directing questions to Kavanaugh about his drinking habits in high school and college due to the recent allegations and instead of answering them he deflected the questions. Then went on to ask Klobuchar the questions he was asked as if Klobuchar was the one being reviewed instead on himself. (3) When he did answer the question he answered with an opposing statement that has been stated by multiple witness on record; Kavanaugh had a drinking problem in college and high school. He stated that he did not. A person who can't even answer basic questions about his history without getting defensive and panicking should not be chosen to be on the Supreme Court. If he is chosen it will truly be a step back for women across America and democracy across America. Which is why I would vote no.

With the data I've gathered researching, I believe that Mr. Kavanaugh is not qualified to be a Supreme Court Justice. To start, Mr. Kavanaugh has had a history of lying when in court, even when under OATH. According to (1) The New York Times, a fellow public servant Mr. Dick Durbin of Illinois made a statement to Kavanaugh, "You say that words matter. You claim to be a textualist when you interpret other people's words, but you don't want to be held accountable for the plain meaning of your own words." This shows hypocrisy to me, and that is absolutely NOT a qualification for this important position. Secondly, according to (2) NBC (National Broadcasting Company) the FBI (Federal Bureau of Investigation) has not interviewed Ford for the investigation, "Ford’s attorneys said in a statement Wednesday after McConnell's action that the FBI supplemental investigation did not include an interview with Ford or others. "An FBI supplemental background investigation that did not include an interview of Dr. Christine Blasey Ford — nor the witnesses who corroborate her testimony — cannot be called an investigation," they said. "We are profoundly disappointed that after the tremendous sacrifice she made in coming forward, those directing the FBI investigation were not interested in seeking the truth." This could be seen as Mr. Kavanaugh trying to hide something, and using his power to do so. Lastly, valuable information from allegations of sexual assault has been kept from the Democratic party according to (3) The Hill, "Democrats slammed Republicans for making tens of thousands of pages of documents from Kavanaugh’s record available to them only hours before his first confirmation hearing, as well as initially barring almost half of the documents from being made public."
I believe that he should not be voted for the position of Justice not because of the accusations alone, but because he has lied about serious matter, when he is under fire his hides away, and he doesn't take a stand like he should in American politics.

If I was a Minnesota Senator, I would probably not vote for the confirmation of Brett Kavanaugh. For starters, while the FBI did conduct an investigation and found nothing of significance, they left out a witness's testimony to the committee (1). Doing this takes away from the voice of a victim who matters the most out of this whole ordeal. In addition, it silences the voices speaking out and makes Brett to be seen as a good person. Next, Kavaunaughs vicious and nasty behavior when Senator Amy Kloubachar questioned him about his past reveals how he really knows the truth and that he is raged because he doesn't want to face the dark truth of his immoral actions (2). Finally, in an MSNBC report (3), it was exposed that about a dozen witnesses were ignored during the whole situation at hand. Obviously, this is hiding a lot of evidence that could stop a hideous man from gaining power. Also, it shows that if there are a dozen more witnesses it pretty much confirms that he had some history with sexual assault. All in all, the amount of noise the victims are making is too much for the committee to not ignore the fact that Kavanaugh's despicable actions should void him from being appointed to the supreme court.

If I was a Minnesota senator on the Judiciary Committee, my decision would to not vote Kavanaugh into the Supreme Court Justice. In "CBS News," (1) Cory Booker stated that the reports had, "hints of misconduct," He also said (and I quote), "It's very frustrating, even the things I read. I heard the chairman of the committee says there are no hints of misconduct, in plain English what I just read there are hints of misconduct," Yes, his quote makes it very unclear what misconducts could possibly be listed, however, there have been three women who confessed the fact that Kavanaugh sexually assaulted them. Usually, for me, three is the magic number for me to be convinced, and three women stepped up and confessed about the assault. Which makes it more of a reason NOT to vote Kavanaugh into the Supreme Court. In "CNN News," (2) Kavanaugh's former classmate, Liz Swisher responded that he was a frequent drinker back at Yale. Another former student named Kerry Berchem, also said that another girl student named Deborah Ramirez had text messages from another student (name unknown) that talks about Kavanaugh and his behaviors. Me personally, I'm not a fan of sketchy things, and the text messages and drinking to me is sketchy. We all know too much drinking can cause us to make stupid and sometimes regretful decisions (Totally not saying Kavanaugh was an alcoholic or a constant drinker), however, the drinking can correlate to the women because most in the world who drinks make a stupid decision like sexual assault. Of course, we can't elaborate on that since the text messages and drinking information on Kavanaugh have been concealed, however, it has a possibility of correlating to the sexual misconducts. In "The New York Times Editorial," (3) it states that "There are the persistent doubts about his truthfulness in telling senators in 2006 that he had no knowledge of Mr. Bush's warrantless wiretapping program or his detainee treatment policy," Everyone who works with the government and in politics has to be honest and tell nothing but the truth. There have been several times where Kavanaugh has been accused of lying as well. Why would you want someone in the Supreme Court Justice who not only is accused of sexual assault but also on the credibility of his truth? My dad has always told me that even though you see it on the news and on news articles, it doesn't mean that it's always true. But in my ways of seeing it, it seems that the news has factual evidence to support why he shouldn't be voted into the Supreme Court Justice. That is why I would not let Kavanaugh be voted into the Supreme Court Justice.

If I was a Minnesota Senator on the Judiciary Committee, my decision would be not to vote for Kavanaugh into the Supreme Court Justice. According to New York Times Editorial Board, it states, "he misstates facts under oath, and Republicans cover for him by making it hard." (1) This shows Kavanaugh is an untrustworthy person and cannot be trusted. Next, according to CNN, it says, "in his testimony to the Judiciary Committee, Kavanaugh attacked Democrats and delivered angriest partisan message heard from a Supreme Court nominee." (2) This shows that Kavanaugh cannot be civil and is very undisciplined. His foolishness in his testimony has shown he is not the right fit to be a Supreme Court Justice. Lastly, according to The Washington Post, Heidi Heitkamp says, "Kavanaugh's partisanship in his defense of himself from sexual misconduct allegations was too much." (3) This statement from Senator Heitkamp shows us that not only her, but millions of people in the United States are disgusted by the recent allegations of Kavanaugh's sexual misconduct. I believe that this shows how explicit and foolish Kavanaugh has been. In conclusion, Kavanaugh's recent allegations of sexual misconduct and his behavior in his testimony has been very explicit and shows that he is ultimately not fit to be a Supreme Court Justice. The key take away from this is why do you have someone who continuously lies and is an offender to women be an elected Supreme Court Justice? This just brings dishonor to the United States.

If I were Minnesota Senator, I would choose not to put Kavanaugh in the Supreme Court. To back up my claim, I would rather have a more thorough investigation on Kavanaugh, cause according to democrats who were able to review said FBI investigations, they say that it is a sham and a cover-up. Someone has to be pulling strings to not let these documents out in the public, and such injustice cannot go undone for anyone who is accused of being a sexual harasser. The truth must be uncovered whether or not it is true. It isn't good for America to have a judge that no one knows if they're reliable or not. Even so this whole thing is a sham, nothing but a pile of lies because Kavanaugh has claimed under an oath that he has not been under the influence to the point of forgetting what he has doing, but even so a few people who had attended Yale with Kavanaugh had claimed that he had gone overboard with alcohol before to the point where he was stumbling and needed assistance leaving. For a judge to be one that lies under an oath is a judge that does not belong in the courts. Along with that Kavanaugh does not seem like a stable man to have as a Supreme Court Justice. John Paul Stevens states that he himself, a lifelong republican, has changed his views on Kavanaugh and believes that he and his personality is not fit for being a Justice due to the fact that his fury during his hearings and his claim that he got "too emotional due to a distorted highschool life."

If I were a Minnesota senator I would vote to not approve judge Kavanaugh to the Supreme Court. He should not be put on the Supreme Court because of all the sexual assault charges that are filed against him, his possible drinking problems, and his behavior when getting interviewed by Sen. Amy Klobuchar. According to the New York Times(1) there is a letter being shared by senators that explains that judge Kavanaugh tries to assault a girl at a party in his teens, along with others that have claimed the same thing. Secondly, according to the Washington Post(2) judge Kavanaugh has lied under oath about being so drunk that he forgot what happened. Some of his college drinking buddies have stepped forward to say that they have personally seen judge Kavanaugh that drunk, which means he lied under oath which is a crime in of itself. Lastly, in the interview(3) that Sen. Amy Klobuchar held against Judge Kavanaugh he got very heated when Sen. Klobuchar started asking him question about his drinking. He is very rude and abrupt when she brings this up and quips back. In conclusion, If I were a senator I would not vote for judge Kavanaugh because someone with that many claims of sexual assault against him, his possible drinking problem and his behavior is court for a job interview was ridiculous.

If I was a Minnesota senator on the Judiciary Committee, I would not vote to confirm Brett Kavanaugh. Kavanaugh is unfit to be a part of the Supreme Court because of his disposition. Firstly, Brett Kavanaugh was accused of sexual assault by Christine Blasey Ford. Not only is this an obvious problem on its own, but it is suspected that he lied under oath about it. Kavanaugh’s former college roommate, James Roche, claims that he lied about the party and never being blackout drunk. ‘"This is not about drinking too much or even encouraging others to drink," Roche writes. "It is not about using coarse language or even about the gray area between testing sexual boundaries with a date and sexual abuse. This is about denial. This is about not facing consequences. This is about lying”’ (1). Kavanaugh also responded aggressively in recent questionings in the court (2). A member of the Supreme Court needs to be someone who understands the importance of judicial questioning since he will be a part of it while on the Court. Kavanaugh has also contradicted and forgotten many of the things he has said in the past. For example, “he testified that Roe v. Wade is “settled as a precedent of the Supreme Court.” But he said essentially the opposite in a 2003 email leaked to The Times” (3). Overall, Brett Kavanaugh should not be voted for because of his past behavior.

If I were a US senator I would vote for Kavanaugh because people are still trying to bring him down from the court cases. Kavanaugh wants to move past this and try to advance the country and to grow as a person. He has confronted what he has done and now it's up to the people to decide what they want for him. The way he has admitted to his mistakes and is trying to move past it shows how persevering he is to keep going. But in the senate at the moment. The likelihood of him getting elected is higher because there is actually more republicans then democrats. That's just because the way they were voted in happen to have 51 republicans and 49 democrats. So this vote will be really close because if a couple people vote a different way then predicted it could end in a tie which could very well happen. In my opinion I would vote for him not based on his crimes but for what he will do to help America. I don't believe someones mistakes in the past will effect someones decision making in the future.

If I were a Minnesota senator on the Judiciary Committee, I would vote not to confirm Brett Kavanaugh for the spot in the Supreme Court Justice. Kavanaugh has proven many times he is not to be trusted, "Judge Kavanaugh seems to have trouble remembering certain important facts...More than once this week, he testified in a way that appeared to directly contradict evidence in the record." (1) Another example is Kavanaugh's old "drinking buddies" came forward and told the opposite of what Kavanaugh has been telling the media, and all of America, "...Brett lied to the Senate by stating, under oath, that he never drank to the point of forgetting what he was doing. We said...on numerous occasions, had seen Brett stumbling drunk to the point that it would be impossible for him to state with any degree of certainty that he remembered everything that he did when drunk." (2) These examples cannot be anything except proof to deny Kavanaugh into the Supreme Court Justice. These must be important examples to prove he is untrustworthy and irresponsible to be given this amount of power. "The allegations...are from the 1980s when Kavanaugh was in high school and college, and an anonymous letter sent to a senator in the past week details an accusation from 1998. Kavanaugh has denied the allegations." (3) Although he has denied these allegations, there is no way to be sure he is telling the truth considering him being untrustworthy many times in the past. There is no way to believe he truly is innocent now that his old friends have debunked him only having "one beer".

If I were a member of the Senate Judiciary Committee, I would not vote to confirm Kavanaugh. Aside from the multiple sexual abuse allegations, "[Kavanaugh] misstates facts under oath, and Republicans cover for him by making it hard...to get the documents proving it."(1) Kavanaugh has been caught in more than a few lies in the last 15 years. One example is that during his initial confirmation hearing, he stated that Roe v. Wade was "settled as a precedent of the Supreme Court". However, there was a leaked 2003 email in which he said the opposite and referred to the Supreme Court's ability to overrule it. Another example of Kavanaugh lying under oath is that during the hearing regarding Dr. Blasey Ford's allegations against Kavanaugh, Kavanaugh was asked to define some, seemingly sexually explicit, terms that were foud in his yearbook (2). It was quickly discovered that Kavanaugh had lied about the true meaning of the slang terms "boof" and "Devil's Triangle" showing that even when faced with questions where the truth can be more easily uncovered, he still chooses to lie. Additionally, on Wednesday night, CNN reported that Kavanaugh's roommate at Yale revealed that Kavanaugh had lied under oath in regard to his drinking habits (3). During his hearing, Kavanaugh testified that he had never been blackout drunk. However, his college roommate, James Roche, reported that he "saw him both what I would consider blackout drunk and also dealing with the repercussions of that in the morning". There are just too many examples of Brett Kavanaugh lying under oath, in order to protect himself. This is not respectable behavior for someone looking to have one of this country's most powerful positions. Simply put, Kavanaugh can't be trusted to tell the truth, so I don't believe that he should be trusted to be a Supreme Court justice

If I were a member on the Senate Judiciary Committee, I would vote against Kavanaugh. Throughout his time in government Kavanaugh has proven himself to be dishonest in regards to things that will affect his career negatively. For example, throughout this case Kavanaugh has been caught misstating "-facts under oath, and Republicans cover for him by making it hard. . . to get the documents proving it"(1). An example of Kavanaugh's dishonesty in court would be how he claimed to have never being drunk to the point of blacking out, yet former Yale alumni have spoken out and said this to be false, and that he had drank past the point of blacking out on various occasions (2). Also, the fact that this isn't the only sexual misconduct allegation under his belt(3), this is just the first one to be made into a public spectacle. It is no secret that there is a lot of underhandedness that goes on in politics, but allowing Kavanaugh to get a seat of honor in the Supreme Court despite these allegations will further encourage dishonesty. Somebody who has no problem being dishonest to those he is meant to protect should not have a place in the Supreme Court.
